Welcome to ArkansasGFX. These Terms of Use govern your access to and use of ArkansasGFX.com, including the purchase, download, and use of digital products offered through the website.
By accessing the website, purchasing a digital product, or downloading files from ArkansasGFX, you agree to these Terms.
Digital Products
ArkansasGFX sells downloadable digital products. Unless a product listing specifically states otherwise, no physical product will be shipped to you.
Digital products may include formats such as SVG, PNG, JPG, JPEG, GIF, DXF, EPS, PDF, ZIP, or other file formats described on the applicable product page.
You are responsible for determining whether the included file formats are compatible with your software, equipment, and intended production method before purchasing.
Your Purchase
Prices are displayed in U.S. dollars unless otherwise stated.
Payment may be processed through third-party payment providers such as Stripe or PayPal. ArkansasGFX does not require customers to create an ArkansasGFX account in order to purchase digital products.
After successful payment verification, ArkansasGFX provides secure access to the files included with the purchased product. Download access may be subject to reasonable expiration dates and download limits displayed or communicated with your order.
Your payment information is processed by the selected payment provider. ArkansasGFX does not intentionally store complete credit card numbers or PayPal account credentials on its own website.
Digital License
Purchasing a digital product does not transfer ownership of the underlying artwork, copyright, design rights, or intellectual property to you.
Instead, your purchase grants you a license to use the design according to the ArkansasGFX Digital License in effect for that product.
The Digital License is incorporated into these Terms by reference.
Unless specifically permitted by the applicable license, you may not resell, redistribute, share, give away, upload, sublicense, or otherwise provide the original ArkansasGFX digital files—or substantially similar digital copies—to another person or service.
Intellectual Property
Unless otherwise stated, ArkansasGFX designs, graphics, website content, branding, logos, product previews, photographs, written content, and downloadable files are owned by ArkansasGFX or used with appropriate permission.
You may not reproduce or use ArkansasGFX branding, website content, product previews, or other protected material except as permitted by these Terms or the applicable Digital License.
Product Images and Previews
Images displayed on ArkansasGFX may be resized, compressed, protected, watermarked, or otherwise prepared for online preview.
Product preview images are intended to demonstrate the design and are not necessarily the same files provided after purchase.
Mockups may show examples of how a design could appear on apparel, signs, drinkware, wood products, printed products, or other items. Unless explicitly stated otherwise, those physical items are not included with the purchase.
Customer Responsibility
Digital fabrication depends on many factors outside ArkansasGFX's control, including software, machines, blades, bits, lasers, printers, materials, settings, calibration, and operator technique.
You are responsible for verifying dimensions, toolpaths, cut settings, print settings, material compatibility, and other production requirements before producing a final item.
ArkansasGFX is not responsible for damaged materials, failed cuts, failed prints, machine damage, lost production time, or other losses resulting from improper settings, incompatible equipment, modification of a design, or misuse of a downloaded file.
Refunds
Purchases are subject to the ArkansasGFX Refund Policy.
Because digital files can be accessed or downloaded immediately after payment, digital purchases are generally considered final once download access has been provided. Exceptions and problem-resolution procedures are explained in our Refund Policy.
Prohibited Use
You may not use ArkansasGFX or its products to commit fraud, distribute malware, violate intellectual-property rights, circumvent download security, obtain products without payment, interfere with website operation, or engage in unlawful activity.
Attempts to bypass secure download restrictions, manipulate payment status, access private files without authorization, or otherwise interfere with ArkansasGFX security may result in access being blocked.
Availability
We work to keep ArkansasGFX and purchased downloads available, but uninterrupted access cannot be guaranteed.
The website may occasionally be unavailable because of maintenance, hosting problems, third-party service interruptions, security events, or circumstances outside our control.
Third-Party Services
ArkansasGFX may rely on third-party services including payment processors, hosting providers, email providers, analytics services, or other technology providers.
Those services may have their own terms and privacy practices.
Limitation of Liability
To the fullest extent permitted by applicable law, ArkansasGFX will not be responsible for indirect, incidental, consequential, special, or business losses arising from use of the website or digital products.
Where liability cannot legally be excluded, ArkansasGFX's liability relating to a purchased digital product will not exceed the amount paid for that product, except where applicable law requires otherwise.
Changes to These Terms
ArkansasGFX may update these Terms as the website, services, products, or legal requirements change.
The effective date shown at the top of this page identifies the latest revision.
Changes will apply prospectively and will not be used to retroactively remove rights already granted under a completed purchase unless required by law.
Governing Law
These Terms are governed by applicable United States law and the laws of the State of Arkansas, without limiting any consumer rights that cannot legally be waived.
